What is Work Permit?

Work Permit is the permission for foreigners to receive salary for their employment in Vietnam. Without a work permit, foreign individuals are not allowed to work in Vietnam. There are some cases that the foreign individuals do not need the Work Permit to work in Vietnam, it is called Work Permit Exemption.

There are many categories for the Work Permit and the requirements for each category are also different. We can understand the categories is known as Experts, Specialists and Executives

How to proceed?

A foreign worker must apply for a work permit or work permit exemption certificate to legally work in Vietnam. The permit allows the foreigner to work in a specific position, company and location. Thus, foreigner workers might hold several work permits.

More importantly, the work permit or work permit exemption certificate do not exempt foreigners to obtain a visa or a temporary resident card.

There are several personal income tax rates which depend on the kinds of personal income such as:

  • monthly wages with progressive rates ranging from 5% to 35%;
  • income from capital investment with a fixed rate of 5%;
  • income from real estate transfer with rates of 2% or 25% depending on the case.

Vietnam laws do not obligate all foreigners working in Vietnam to obtain a work permit. Work permit is not required for foreigners entering Vietnam (i) less than three months to offer services, or (ii) to work as experts, managers, CEOs, technical employees for a period of under 30 days and an accumulated working period of under 90 days per year…

Foreigners may be granted more than 01 Work Permit, because foreigners can be simultaneously employed by multiple employers under more than 01 labour contract. Term and content of each work permit granted is subject to their labour contract(s).

Yes. The work permit is not applicable to the company’s owners and members of the Board of Management of a Joint Stock Company. In this case, they should obtain a certificate of work permit exemption.

No. The work permit is granted by the competent agency where the employee’s work is performed.

No. Monetary fine applies to not only the company, but foreign employees; in addition, such foreign employees may be deported for working in Vietnam without Work Permit.
